1. Acceptance of Terms

By accessing or using WhatsMyGap ("the Service"), operated by Z Enterprises, LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Nature of the Service

WhatsMyGap is an educational tool designed to help Kentucky homeowners identify potential gaps in their insurance coverage. The Service is not an insurance provider, broker, or licensed advisor. The information provided does not constitute insurance advice, financial advice, or any professional recommendation.

You should always consult a licensed insurance professional before making coverage decisions. We do not sell, bind, or issue insurance policies.

3. No Warranties on Accuracy

While we strive for accuracy, the Service relies on publicly available data (including FEMA NFIP claims data), user-provided inputs, and generalized rate benchmarks. We make no warranties, express or implied, regarding:

• The accuracy, completeness, or timeliness of any analysis or report
• The applicability of any recommendation to your specific situation
• Rate estimates, which are approximations based on publicly filed data and may not reflect your actual premium

4. Limitation of Liability

To the maximum extent permitted by law, Z Enterprises, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

Our total liability for any claim arising from use of the Service shall not exceed $100.

5. Intellectual Property

The WhatsMyGap gap analysis engine, scoring algorithms, coverage rule sets, and all associated content are proprietary to Z Enterprises, LLC. You may not copy, reverse-engineer, reproduce, or distribute any part of the Service without express written permission.

Reports generated for your personal use may be shared freely, but may not be used for commercial purposes without our consent.

6. Affiliate Relationships

The Service may contain links to third-party insurance carriers and partners. We may earn referral commissions from these links. Affiliate relationships do not influence our analysis or recommendations. See our Affiliate Disclosure for full details.

7. User Conduct

You agree not to:

• Use the Service for any unlawful purpose
• Submit false or misleading information
• Attempt to reverse-engineer, scrape, or automate access to the Service
• Interfere with or disrupt the Service's operation

8. Modifications

We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Kentucky, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Fayette County, Kentucky.
